The general conditions of sale below apply to the users of the sales platform www.olajoya.com, called "CLIENT" and the company OLAJOYA called "COMPANY".

ARTICLE 1 THE PRODUCT

All products on sale on the www.olajoya.com sales platform are the property of OLAJOYA. The products are described and presented according to their main characteristics.

The products are offered for sale within the limits of available stocks.

The prices of products sold on the site are indicated in euros all taxes included excluding shipping costs.

The offers of PRODUCTS and prices are valid only as long as they are visible on the site and within the limits of available stocks.

The company OLAJOYA reserves the right to modify its prices at any time without notice. The company agrees to apply the rates in effect at the time of registration of the order.

In case of price difference of the same product on different places of the site, it is the price mentioned on the product sheet that will prevail. In case of obvious price error (product indicated at 0 euro for example, or for a value much lower than what we are entitled to expect from the price of an item) the customer service will contact the customer in order to warn of the error, who may if he wishes, cancel his order without penalty for any of the parties.

All orders made on the sales platform are payable at the time of order. Therefore, OLAJOYA company reserves the right to suspend any order management and any delivery in case of refusal of authorization of payment by credit card from officially accredited bodies or in case of non-payment as well as any order from a consumer who has not fully paid a previous order or with whom a payment dispute is being administered.

The CUSTOMER may proceed to the settlement of his order by the following means:

- Payment by credit card via the HIPAY secure module

- Payment from your Paypal account

ARTICLE 2: THE ORDER

The order process is as follows:

- the customer chooses his or her articles,

- the customer settles his order, via HIPAY or his PAYPAL account

- the products are shipped to the delivery address provided by the customer when ordering.

The company OLAJOYA reminds CUSTOMERS, the need to provide a complete address to ensure delivery in the best conditions and time. Any information or additional address is necessary to ensure optimal delivery (street number, building number, building name ...)

In accordance with Article 1369-5 of the Civil Code relating to the conclusion of a contract in electronic form, the CLIENT will be able to view the details of his order and his total price, correct any errors, before confirming it for express his acceptance.

The company OLAJOYA will bear the risks weighing on the PRODUCTS only until the delivery of these to the address indicated by the CLIENT on the order form.

ARTICLE 3: DELIVERY

The DELIVERY time begins to run once the CONTROL is fully set. This time will be specified on the order check page of the CUSTOMER. The CLIENT has the obligation to check the conformity of the goods delivered at the time of delivery.

Any anomaly concerning the PRODUCT (damage, missing product compared to the order form, damaged package, broken product, defective ...) must be indicated immediately upon delivery and as soon as possible (7 days), and this in accordance with the conditions and modality of article 8 of these Terms and Conditions.

Any error or modification made by the CUSTOMER in any current delivery order will result in an extension of the delivery period.

The resulting additional costs will be borne by the customer. Packages are usually shipped within 2 days after receipt of payment. They are shipped via Colissimo with a tracking number and delivered without signature. We advise you to be precise in the indicated address to facilitate the delivery of your parcel. Any additional address (street number, street, building, staircase ...) can better locate you.

Please note that deliveries to countries outside the European Union may be subject to various charges and taxes, including customs and import VAT. These costs are borne exclusively by the buyer.

ARTICLE 4: LEGAL COMPLIANCE & GUARANTEE

For the lack of conformity, the CUSTOMER must mention as soon as the delivery and as soon as possible, in accordance with article 8 of these GTS, all the defects of conformity to the company OLAJOYA, and this in particular with the information following:

- order number; - surname, first name and address;

- reference of the articles concerned;

- reason (s) for return for non-compliance.

This warranty is however limited to normal use of the product.

If the lack of conformity is proven, the customer can obtain, and this within a period of 7 days from the reception by the company of the defective product:

- The exchange of its product with another product of the same value

- A credit to use on the entire sales platform

- The full refund of his payment.

Will be refunded the price of the goods but remains the responsibility of the customer the costs of sending back and forth.

The OLAJOYA company is not held responsible for apparent defects that the CUSTOMER could have personally noticed and which he could have convinced himself.

However, under articles 1641 and following of the Civil Code, all PRODUCTS enjoy the legal guarantee against latent defects that render them unfit for the use for which they are intended, or which reduce such use so much that the buyer would not have acquired them, or would have given them a lesser price, had he known them.

ARTICLE 5: RIGHT OF WITHDRAWAL

For information, exchanges are possible up to 7 days from the date of order.

Legal right of withdrawal

In accordance with Article L.121-20 of the Consumer Code, our customers have a period of seven (7) clear days from receipt of goods to exercise their right of withdrawal without having to justify reasons or to pay penalties, except return fees.

The withdrawal period is respected if you ship the goods within the aforementioned period or informs us of the exercise of the right of withdrawal within the same period. Notification of the exercise of the right of withdrawal may be sent to us by post to the address mentioned above.

The goods must be returned to us in perfect condition for marketing in new condition.

You have the right to open the packaging and to try the delivered products as long as it does not render the goods unfit for marketing. For hygiene reasons, swimsuits and other items sold on the site www.olajoya.com must be returned to us unused, otherwise the refund can not be made.

ARTICLE 6: PROTECTION OF PERSONAL DATA

In the context of the operation of the www.olajoya.com website, the COMPANY may collect personal data. These data will be processed in accordance with the intended purposes of the collection.

It is recalled that the person whose personal data are processed has the rights of access, rectification and opposition to the processing of his personal data.

These rights can be exercised, in accordance with the law of January 6, 1978, as modified by the law of August 6, 2004 by simple request by email to the address olajoya@outlook.fr

ARTICLE 7: OUR LIABILITY

The responsibility of the company OLAJOYA will in no case be engaged in case of non-performance or improper performance of contractual services attributable to the CUSTOMER including the seizure of the order.

The company OLAJOYA can not be held liable, or considered as having failed these conditions, for any delay or non-performance, when the cause of the delay or non-performance is related to a case of force majeure as defined by the jurisprudence of French courts and tribunals.

The company OLAJOYA thus releases its responsibility for any failure to its contractual obligations, in any event of force majeure (strikes, bad weather ....) not allowing the good execution of the orders.
